NOTICE IS GIVEN THAT THE CITY COUNCIL OF THE CITY OF LAMESA, TEXAS, WILL MEET IN A SPECIAL CALLED MEETING AT 5:30 P.M. ON TUESDAY, MARCH 25, 2014, 601 SOUTH FIRST STREET, FOR THE PURPOSE OF CONSIDERING AND TAKING OFFICIAL ACTION ON THE FOLLOWING ITEMS:

  1. CALL TO ORDER:
  2. ATMOS ENERGY NEGOTIATED SETTLEMENT AGREEMENT: Consider passing an ordinance on second and final reading approving a negotiated settlement agreement between the Steering Committee of cities served by Atmos West Texas ( Cities ) and Atmos Energy Company s 2013 Statement of Intent to increase rates in all cities exercising original jurisdiction; declaring existing rates to be unreasonable; adopting tariffs that reflect rate adjustments consistent with the negotiated settlement and finding the rates to be set by the tariffs attached to the settlement agreement to be just and reasonable; approving a new rate review mechanism; requiring the company to reimburse cities  reasonable ratemaking expenses; repealing conflicting  resolutions or ordinances; determining that this ordinance was passed in accordance with the requirements of the Texas Open Meetings Act; adopting a saving  clause; declaring an effective date; and requiring delivery of this ordinance to the company and the cities  legal counsel.
  3. ACQUISITION OF RIGHT-OF-WAY AND EASEMENT: Consider passing a resolution authorizing the purchase of a right-of-way and easement for the North Sewer Line Project and authorizing Mayor Dave Nix to execute all documents required to purchase such Easement and Right-of-way covering the following described property, to-wit:

All of the West Twenty-five (W/25) feet of the South 1,700 feet of the Southeast One-fourth (SE/4) of Section Forty-one (41), Block Thirty-five (35), T-6-N, T. & P. Ry. Co. Survey, in Dawson County, Texas.

  1. CALL FOR BIDS:  Consider calling and advertising for bids on the North Sewer Line and the U.S. 87 Water System Improvement Projects

5.    ANNEXATION PUBLIC HEARING (Michael & Deena Tyler):  Convene a second public hearing in accordance with state law giving all persons the right to appear and be heard on the proposed annexation by the City of Lamesa, Texas of the following described property to-wit:

That the land sought to be annexed and made a part of the City of Lamesa, Dawson County, Texas, is all of that land located in Section 71, Block 35, T-6-N, Georgetown Ry. Co. Survey, in Dawson County, Texas, which is described on Exhibit A attached hereto and incorporated herein by reference for all purposes.

6.    ANNEXATION   T-6-N, GEORGETOWN RY. :  Consider passing an ordinance on first reading annexing the following tract in accordance with State Law, on proposed annexation by the City of Lamesa, Texas of the following described property to-wit; All that certain lot, tract or parcel of land lying and being situated in Dawson County, Texas: and described as follows:

That the land sought to be annexed and made a part of the City of Lamesa, Dawson County, Texas, is all of that land located in Section 71, Block 35, T-6-N, Georgetown Ry. Co. Survey, in Dawson County, Texas, which is described on Exhibit A attached hereto and incorporated herein by reference for all purposes.

  1. SPECIFIC USE PERMIT    809 SOUTH 2ND STREET:  Consider passing an ordinance on second and final reading issuing a Specific Use Permit to Irma Acevedo, Lot 5, of the McFarlin Subdivision located at 809 South 2nd  Street for use as a home occupation (message therapy in one room of the residence).
  2. GENERAL ELECTION:  Consider passing an ordinance on second and final reading declaring the unopposed candidates for the 2014 City of Lamesa General Election to be held on May 10, 2014, elected to office.
  3. APPOINTMENTS - ELECTION OFFICIALS:  Consider passing a resolution appointing a presiding judge and alternate judge for the 2014 City General Election and a presiding judge for the Early Voting Ballot Board; clerks for early balloting; and to provide for compensation of services for the 2014 City General Election to be held on May 10, 2014.
  4. CITY MANAGER REPORT: City Manager to report on current activities and answer questions from the City Council.
