NOTICE IS GIVEN THAT THE CITY COUNCIL OF THE CITY OF LAMESA, TEXAS, WILL MEET IN A REGULAR CALLED MEETING AT 5:30 P.M. ON TUESDAY, MARCH 18, 2014, 601 SOUTH FIRST STREET, FOR THE PURPOSE OF CONSIDERING AND TAKING OFFICIAL ACTION ON THE FOLLOWING ITEMS:

CONSENT AGENDA:  All consent agenda items listed are considered to be routine by the City Council and will be enacted by one motion.  There will be no separate discussion of these items unless a Council Member so requests, in which event the item will be removed from the Consent Agenda and considered in its normal sequence on the agenda.  Information concerning consent agenda items is available for public review.
  1. APPROVAL OF THE MINUTES:  Approval of the minutes of the council meeting held on February 18, 2014.
  2. BILLS FOR FEBRUARY 2014:  Approval of the bills paid by the City of Lamesa for the month of Februay 28, 2014.
  3. BOARD APPOINTMENTS: Approval of appointments to the Boards & Commissions.

LAMESA MUNICIPAL GOLF ADVISORY BOARD: Consider appointing one (1) member to fill an unexpired term ending on December 31, 2017. (Adriana Sauseda)

  1. ATMOS ENERGY NEGOTIATED SETTLEMENT AGREEMENT:  Consider passing an ordinance on first reading approving a negotiated settlement agreement between the Steering Committee of cities served by Atmos West Texas ( Cities ) and Atmos Energy Company s 2013 Statement of Intent to increase rates in all cities exercising original jurisdiction; declaring existing rates to be unreasonable; adopting tariffs that reflect rate adjustments consistent with the negotiated settlelement and finding the rates to be set by the tariffs attached to the settlement agreement to be just and reasonable; approving a new rate review mechanism; requiring the company to reimburse cities  reasonable ratemaking expenses; repealing conflicting  resolutions or ordinances; determining that this ordinance was passed in accordance with the requirements of the Texas Open Meetings Act; adopting a saving  clause; declaring an effective date; and requiring delivery of this ordinance to the company and the cities  legal counsel.
  2. ELECTRONIC COMMUNICATION DEVICES IN SCHOOL ZONES:  Consider passing an ordinance on second and final reading amending Chapter 12,  Traffic and Vehicles  of the Code of Ordinances of the City of Lamesa, Texas to include sections prohibiting the use of wireless communication devices while operating a motor vehicle within school crossing zones within the city, to provide for defenses and  penalties, to provide for repeal of all conflicting ordinances, and to provide for publication and  an effecrtive date.
  1. ANNEXATION PUBLIC HEARING (Michael C. Tyler and wife Deena L. Tyler):  Convene a first public hearing in accordance with State Law, giving all persons the right to appear and be heard on the proposed annexation by the City of Lamesa, Texas of the following described property to-wit: 

That the land sought to be annexed and made a part of the City of Lamesa, Dawson County, Texas, is all of that land located in Section 71, Block 35, T-6-N, Georgetown Ry. Co. Survey, in Dawson County, Texas, which is described on Exhibit A attached hereto and incorporated herein by reference for all purposes.

  1. PUBLIC HEARING ON REQUEST FOR SPECIFIC USE PERMIT:  Convene in a public hearing on issuing Specific Use Permit to:

CASE NO. PZ 14-1: To consider the petition of IRMA ACEVEDO at 809 SOUTH 2nd Street requesting a specific use permit of the following property:

LOT 5 OF THE MCFARLIN SUBDIVISION to the City of Lamesa, Dawson County, Texas located at 809 South 2nd Street for use as a home occupation (massage therapy room in one room of the residence).

  1. SPECIFIC USE PERMIT   809 SOUTH 2ND STREET:  Consider passing an ordinance on first reading issuing a Specific Use Permit to Irma Acevedo, Lot 5, McFarlin Subdivision located at 809 S. 2nd Street for use as a home occupation (message therapy in one room of the residence).
  2. RODEO GROUNDS LEASE:        Consider passing a resolution approving an agreement between the City of Lamesa and the Lamesa Rodeo Association for the lease of the rodeo grounds.
  3. WATER CONSERVATION PLAN:  Consider passing an ordinance on first reading approving revisions to the Water Conservation Plan; establishing criteria for the initiation and termination of drought response stages; establishing restrictions on certain water uses; establishing penalties for the violation of and provisions for enforcement of these restrictions; and establishing procedures for granting variances as required by Section 11.1272 of the Water Code of the State of Texas.
  4. GENERAL ELECTION:  Consider passing an ordinance on first declaring the unopposed candidates for the 2014 City of Lamesa General Election, to be held on May 10, 2014, elected to office.
  5. FINANCIAL REPORT: Director of Finance, to report on the city s finances.

The City Council reserves the right to adjourn into closed session at any time during the course of this meeting to discuss any of the matters listed above, as authorized by Texas Government Code Section 551.071 (Consultation with Attorney), 551.072 (Deliberations about Real Property), 551.073 (Deliberations about Gifts and Donations), 551.074 (Personnel Matters), 551.076 (Deliberations about Security Devices) and 551.087 (Economic Development).
